VI. What If I Was A Passenger In The Fault Driver’s Car?

You may bring a claim against the driver of the car you were in if he was negligent and causes injury to you. This is true whether the driver of car you were riding in causes a collision with another car, causes a single car accident, or strikes a fixed object like a telephone pole. As discussed in Chapter V, there are often practical concerns about making such claims. However, legally, these claims are allowed. If you are injured in a collision and need to collect insurance money for lost wages and/or medical bills, you may have no choice but to pursue a claim against the driver of the car in which you were a passenger.
